Senate Battle Over Judges Concerns Business

WASHINGTON (Reuters) - Paul Miller and other business lobbyists are worried that a battle over President Bush's judicial nominees may tie the Senate into knots, endangering legislation they want turned into law.
"We are alarmed," said Miller, a lobbyist on Capitol Hill since 1996 who has headed the 700-member American League of Lobbyists since January.
"If things break down and nothing gets done, we and others will tell them, 'Enough is enough' ... 'Get things done or else you won't be back."'
The business community helped Republicans expand their majorities in Congress in last year's elections and now wants them to pass a crush of legislation.
A major energy bill and transportation measure are on its wish list, along with a proposed trade agreement with Central American nations, tax relief and legislation to revamp medical malpractice laws.
Miller voices frustration with Democrats and Republicans, who blame each other for their high-stakes showdown over judges that may come to a head within weeks.
Republicans threaten to change the Senate rules to ban procedural hurdles known as filibusters that Democrats have used to block 10 of Bush's most controversial judicial nominees.
Democrats vow to retaliate to such a rule change by using other procedural tactics to stall action on legislation that they consider nonessential.
Overall, business, like congressional Republicans, would like more conservatives on the federal bench, figuring such jurists would make the courts more amenable to their positions on matters from labor to product liability.
Yet at least some are concerned that banning the filibuster -- denounced by critics as "the nuclear option" because of the damage it could do to Senate bipartisanship -- may prove to be too big a price to pay.
"Everybody who knows anything about this is concerned," said a member of a business trade group speaking on the condition he not be identified by name. "We'd hate to see Senate action come to a halt. Things need to get done."
'HOW UGLY DOES IT GET?'
Democrats promise to be selective in slowing down the Senate. Yet many fear the battle could paralyze the chamber.
"There's going to be a big fight. The only question is how ugly does it get," said Ethan Siegal of The Washington Exchange, which tracks Congress for institutional investors.
Republicans control the Senate, holding 55 of 100 seats. Sixty votes are needed to end a filibuster; 51 would be needed to change the rules to ban filibusters on judicial nominees.
At this point, key questions include: Can Democrats and Republicans somehow reach a compromise, and if not, can Republicans muster 51 votes to change the rules?
Several Senate Republicans have voiced concerns that a rule change could stop legislation and hurt them in a future Democratic-led Senate.
"We are all concerned, but we'll get the votes," vowed Sen. Orrin Hatch, a Utah Republican, saying Democrats cannot be allowed to continue to block the will of the majority.
Democrats argue that the filibuster must be preserved to maintain a check on the majority's power.
Bruce Josten, executive vice president of the U.S. Chamber of Commerce, said eliminating the filibuster "is only too big a price to pay" if Democrats "shut the place down."
"The next question is for how long? If it's for two days, it's not too big a price," Josten said. "If it's for weeks, it's a whole different deal."
Democrats vow "long-term" retaliation.
"If that happens, then you are in a game of chicken," Josten. "Neither side can afford to sit there and do nothing."

[The following is an Opinion Piece that was printed in the Viewpoint section of 'The Charlotte Observer' today 4-8-05 and written by a good friend of mine about their Sons Third Deployment into the War Theaters of Iraq and Afganistan. What isn't in the writeup about their son Jim is that after already doing a Tour in Afganistan, and thinking he could get an Army School on return, they instead recieved orders for a Tour in Iraq with little time before deployment. In that short time he Married his SweetHeart and they are now Proud Parents of their First Child, and as Amy writes New Daddy Jim is Heading back to Afganistan!!]

Off again to that other war
Son's regiment leaves for 3rd tour of duty

Today my husband and I will travel to Fayetteville to say goodbye to our older son as he departs, one more time, for Afghanistan. The 504th Parachute Infantry Regiment will be leaving for their third tour of combat duty since December 2002, most likely for at least a year. It won't make huge headlines like the NCAA championship. It probably won't get mentioned at all because the focus is on Iraq, while bodies are still needed for the real war on terrorism in Afghanistan.
They've been to Afghanistan once together, and then to Iraq, this group of young men. When they come home, they will have spent more time together in combat than any soldiers since World War II.
It's no secret that that my husband and I have been adamantly opposed to the invasion of Iraq, which is tying up so many troops in the overburdened Army that soldiers, active and Reserve, are being deployed over and over again. But no matter. They, we, are still in Iraq, and they will be off to war one more time.
So, here we go again, through the guarded gates of Fort Bragg. We'll all joke around together, and we'll promise weekly care packages, and we'll hug, and I'll turn away as my soldier son says goodbye to his wife and infant daughter. He'll turn and disappear, one more time, to the other side of the earth, to a desert that will not be friendly or hospitable.
I've contemplated this scenario a thousand times during the last month or so, trying to mentally steel myself for the real thing, to gather enough strength to get through those moments without crumbling. In the book "Gilead," Marilynne Robinson writes about a preacher's reflection on Abraham's having to send Ishmael, a son he loved, into the wilderness at the bidding of God. Ishmael is rescued from death by an angel and goes on to build a nation. "Great faith," the preacher writes to his own son, "is required to give the child up, trusting God to honor the parents' love for him by assuring that there will indeed be angels in that wilderness."
Godspeed, 504th. Take care of each other and come home safe. All that the rest of us can do is trust that, one more time, there will be angels in that desert.

Bush joined throngs of the faithful today in paying final respects to Pope John Paul, the pontiff whose stands on abortion and other social issues meshed with his but who criticized both him and his father, former president George H.W. Bush, for waging war with Iraq.
Not only was Bush Jr. the first U.S. president to attend a papal funeral, he also headed a delegation to the three-hour funeral mass that included his father and former president Bill Clinton.
When the president's face appeared on giant screen TVs showing the ceremony, many in the crowd outside St. Peter's Square booed and whistled.
Bush rode to Vatican City in a limousine displaying two flags, the customary American flag on the right fender and, as a tribute to the Pope, the white-and-yellow Vatican banner on the left.
On Thursday, Bush offered fresh regrets to Italian Prime Minister Silvio Berlusconi over last month's shooting death of an Italian intelligence officer in Iraq by U.S. troops, his spokesman, Scott McClellan, said.
Bush stayed out of public view on Thursday, meeting privately with Italian leaders and U.S. Catholic leaders in town for the funeral.
The president wanted to stay out of the limelight ahead of the funeral because "he recognizes the significance of the moment," said McClellan.
Relations between the United States and Italy were strained last month when U.S. troops in Iraq fired on a car rushing an Italian journalist to freedom, killing an Italian intelligence officer and wounding the reporter.
Berlusconi denounced the attack. Shortly thereafter, he announced plans to start drawing down his country's 3,000-strong contingent in Iraq in September, although he said the two events were not related.

I wonder if David Horowitz plan to protect poor "conservative students" from "the tyranny of liberal professors" is part of the process to further dumb down Americans, kill critical thinking and make it easier for Fascism to come to this country.

**Is Clear Channel Trying to Kill Air America?**
Yes, if the mess at KTLK, Los Angeles is any indication.
This new station started off with great fanfare, as the triumphant return of Air America Radio to the Los Angeles market, from which it had unceremoniously vanished in a business dispute only three weeks after it began. There was a lot of interest in KTLK, helped along by Clear Channel's heavy promotion of a triple frequency switch in which two L.A. radio formats moved to new stations, leaving a third station available for Air America and other similar products such as the Ed Schultz show.
However, the problems with KTLK have been many, and Clear Channel has gone out of its way NOT to deal with them.
For a start, the Los Angeles Clippers basketball team is contracted to broadcast ALL its games on KTLK. No, I did not misspeak. The Los Angeles CLIPPERS. They are the best kept secret in Lakertown. They are the other L.A. basketball team. As much as the Lakers stink this year, well, that's how badly the Clippers stink every year. They are a guaranteed black hole in any Los Angeles radio schedule. You can probably watch the ratings go down.
Clear Channel could not move the Clippers to the new sports station, because it already carries the Lakers. And so it stayed on KTLK, with no explanation whatsoever. In the station's crucial first week, thousands of people tuned in to the make-or-break afternoon drive time to find a basketball game instead of the advertised "Progressive Talk." Many thought they'd heard it wrong, and never came back.
The Clippers were on an extended road trip, blowing out KTLK's afternoon drive for weeks. I doubt the station ever recovered. Not too good for Air America, either, given that the slot usually goes to a delayed airing of AAR heavy hitter Randi Rhodes.
It gets worse. Weekend programming changes literally from week to week. Jesse Jackson, not Air America but good for diversity in the L.A. market, comes and goes unpredictably, never at the same time twice. KTLK has announced that - marvel of marvels - Jackson will finally have a regular Saturday slot. Unfortunately, this slot is the same time as AAR's very popular Laura Flanders Show.
Two weeks ago, Laura was cut into for a Michael Jackson interview. This would have been a great move anywhere but Los Angeles, where the Jackson trial is on the news 24/7. We're sick of Michael Jackson. Run his interview, sure, it's good for ratings and diversity besides, but not when Laura Flanders' demographic, which is about as different as you can get and still have it be radio, is listening. Dumb move.
This week, Flanders and the popular Ring of Fire show leading into it, are both gone. The replacement is some kind of syndication about travel stories. ????????
Perhaps all of this meat-axe programming gives us some idea of why KTLK has never, ever, ever, published a program schedule. No program schedule. Vague lists of weekday programming have been announced on-air, but otherwise you're on your own.
Los Angeles has 83 radio stations. A station which does not publicize its schedule hasn't a prayer. It cannot even be seen as a serious attempt to attract an audience.
Therefore, the only remaining conclusion is that KTLK, and Air America Radio, are being set up to fail miserably in Los Angeles.
Bet THAT will get publicity.........

I think it speaks volumes to bush (and the anger about his policies) when people who are attending the funeral of THE POPE take timeout of a solemn ceremony to boo the guy.
I am not catholic, but I am thinking that if I were at a funeral for a loved one, i wouldn't take time out o boo, whistle hiss or jeer unless I had some pretty damm strong feelings. It seems to me that the Catholics really (and I don't like the word) hate the guy.
